Terms of Service — 0xGünther

§ 1 Scope

These Terms of Service (hereinafter "ToS") govern all contractual relationships between 0xGünther Architecture Labs (sole proprietorship, Zurich, Switzerland) and its customers (hereinafter "Customer") via the website 0xguenther.org and all subdomains. Deviating terms of the Customer shall not be recognized unless their validity is explicitly confirmed in writing.

§ 2 Subject Matter

The subject of the contract consists of digital products and services offered via 0xguenther.org, including but not limited to:

Playbooks – Digital architecture compendiums with source code (e.g., Günther Craft Playbook)
Skills / MCP Servers – Modular, production-ready software plugins and hardened MCP servers
B2B Agent Setups – Bespoke autonomous AI agent systems for businesses (Clawcommerce)

The specific product description is derived from the respective product page at the time of order.

§ 3 Payment Terms

Payments are processed via the certified payment service provider Stripe Inc. The following payment methods are accepted: credit card (Visa, Mastercard, American Express) and other payment methods supported by Stripe.

All prices are in US Dollars (USD) unless explicitly stated otherwise.

For certain products or services, prices may be denominated in Swiss Francs (CHF).

All prices are final prices. Any applicable value-added tax is included in the price where applicable.

The purchase price is authorized and charged via Stripe upon completion of the order process. Invoicing is conducted exclusively through Stripe.

§ 4 Delivery & Fulfillment

Digital products are delivered automatically via download link to the email address provided during the payment process after verified payment. The contract is fulfilled upon provision of the download link.

Download Token: The download link contains a cryptographic token (HMAC SHA-256) valid for 48 hours and limited to a maximum of 5 downloads.

After token expiration or reaching the download limit, re-issuance is only possible in exceptional cases upon request.

B2B Agent Setups (Clawcommerce) are individually agreed upon. The delivery timeline is specified in the respective order confirmation.

§ 5 Right of Withdrawal

The products sold via 0xguenther.org are digital content not supplied on a tangible medium. By commencing the download or upon provision of the digital content, the Customer expressly consents to immediate performance and waives the right of withdrawal.

This is in accordance with Art. 40a of the Swiss Code of Obligations (OR) and the EU Directive 2019/770 on digital content and digital services, which stipulates that no right of withdrawal exists for digital content not supplied on a tangible medium once performance has begun with the express consent of the consumer.

§ 6 Liability

All software products and digital content are provided "as is". No warranty is given for fitness for a particular purpose, error-free operation, or the achievement of specific economic results.

Liability for slight negligence is excluded to the extent permitted by law. Liability for intent and gross negligence remains reserved. Liability for indirect damages, loss of profit, or consequential damages is expressly excluded to the extent legally permissible.

Liability for the correct functioning of the Customer's infrastructure (server, hosting, network) lies exclusively with the Customer.

§ 7 Intellectual Property

All content, software, source code, text, graphics, and trademarks on 0xguenther.org are the property of 0xGünther Architecture Labs or its licensors and are protected by copyright.

Skills / MCP Servers: Licensed under the MIT License, unless stated otherwise on the respective product page. Commercial use and modification are permitted; resale of unmodified original files is prohibited.

Playbooks: Provided under a proprietary license. The license grants the buyer a non-transferable, non-exclusive right of use for internal purposes. Redistribution, reproduction, or public disclosure – in whole or in part – is prohibited without prior written consent.

B2B Agent Setups: License terms are defined by the individual contract between 0xGünther Architecture Labs and the Customer.

§ 8 Data Protection

Collection, processing, and use of personal data are carried out in compliance with the Swiss Data Protection Act (revDSG) and the EU General Data Protection Regulation (GDPR), where applicable. Details on data processing, data subject rights, and service providers can be found in the Privacy Policy.

§ 9 Governing Law & Jurisdiction

These ToS and all contractual relationships based thereon are governed exclusively by the laws of the Swiss Confederation, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

The exclusive place of jurisdiction for all disputes arising from or in connection with these ToS is Zurich, Switzerland, to the extent permitted by law.

§ 10 Amendments

0xGünther Architecture Labs reserves the right to amend these ToS at any time. Amendments will be published on the website at 0xguenther.org/en/terms.html and take effect upon publication. Customers will be notified of material changes via email, where contact information is available.

The version of the ToS in effect at the time of the order shall apply.
